Facilitation in Building Strengthening Regulations

The Ministry of Environment, Urbanization, and Climate Change has introduced regulatory facilitations for the strengthening of buildings constructed in accordance with the zoning regulations at the time of obtaining their permits. The recent amendment in the Planned Areas Zoning Regulation, published in the Official Gazette, outlines the principles to be followed in permit applications for the strengthening of buildings where strengthening is possible.

With this amendment, bureaucratic obstacles in strengthening buildings as a precaution against earthquake risks have been reduced, providing ease for property owners.

According to the new regulation, applications for strengthening permits to municipalities can be made with documents such as title deed information, static reinforcement project, and documents related to the contractor, site supervisor, and construction inspection.

When applying for a strengthening permit for a building where strengthening is possible, instead of the unanimous consent of all owners, only the approval of at least 4 out of 5 owners, according to the provisions of the Condominium Ownership Law, will be required.

Buildings constructed in accordance with the zoning rules at the time of obtaining permits can be strengthened according to the principles of the current Turkish Earthquake Building Regulation, except for the rules specified in the regulation, without the need for any other conditions.

Re-adjustment of architectural, electrical, and mechanical projects will not be required for compulsory cross-sectional changes to be made in the load-bearing system. Other essential documents for the architectural project, such as canal axis and application sketch, will not be required.

Additionally, the enlargement of dimensions such as the load-bearing system’s columns and shear walls will not be considered in the calculation of the parcel’s zoning and base area, preventing any reduction in construction rights regarding zoning and construction areas.
