New real estate regulation: Advertisements cannot be placed at different prices for the same residence

Natural and legal persons who provide electronic media for advertisements for the sale of real estate belonging to others will not be able to enter advertisements with different prices for the same place.

The Ministry of Commerce prepared the “Draft Regulation on Amendments to the Regulation on Real Estate Trade”.

The regulation aimed to eliminate the problems encountered in the implementation of the current regulation published in the Official Gazette in 2018 and to meet the demands and expectations of sector representatives.

Within the scope of the draft submitted to the opinion of relevant institutions and organizations, the conditions required for real estate businesses operating or wishing to operate in real estate trade to obtain an authorization certificate will be regulated.

Professional experience requirement will be removed

Accordingly, the professional experience requirement will be abolished in order to prevent real estate businesses that cannot meet the professional experience requirement, despite meeting other necessary conditions, from operating without an authorization certificate and to eliminate the problems experienced in this regard in the sector.

Real estate advertisements regulation

Obligations regarding advertisements on the internet are also regulated. In this context, real or legal persons who provide electronic media for advertisements for the sale of real estate belonging to others will not be allowed to post more than one advertisement with different prices for the same place.

In this way, it is aimed to prevent speculative price increases and to prevent information pollution in advertisements on electronic service platforms.

Fines of different amounts will be applied to advertisements placed in violation of the rules, depending on the nature of the crime in the relevant laws.

On the other hand, the rule regarding “not having received a finalized prison sentence of more than 5 years due to a crime committed intentionally”, which is one of the conditions for issuing a certificate of authority, will be changed to “not having received a finalized prison sentence of 5 years in total due to a crime committed intentionally”.

The implementation of administrative fines for those who carry out real estate trading activities without an authorization certificate will be transferred to the provincial directorates.
