
The long-standing legal dispute between Porland Porselen and Pasabahce over a tea saucer design has finally concluded in favor of Pasabahce. The Constitutional Court of Türkiye (AYM) rejected Porland’s individual application claiming a rights violation, marking the end of a 10-year legal saga.
According to the ruling published in the Official Gazette, Porland had applied to the Turkish Patent and Trademark Office nearly a decade ago to register the design of a tea saucer it had been using. However, the registered design was later canceled and published in the official design bulletin.
In response, Pasabahce objected to the registration, arguing that Porland’s design was “identical or similar” to its own previously registered tea saucer model and lacked distinctiveness. The objection was submitted to the Re-Examination and Evaluation Board (YIDK) of the Turkish Patent and Trademark Office.
The legal proceedings escalated through the years, reaching the appeals court in 2018 and the Constitutional Court in 2020.
Ultimately, AYM found Porland’s claim inadmissible and dismissed its case, upholding Pasabahce’s rights over the disputed tea saucer design.
