Transferring property & Title deed works will become very easy in Turkiye beginning 2023

With the new year comes new regulations in real estate buying and selling.

As of January 1, 2023, a new period will begin for the sale of title deeds from the notary public, especially the sale of housing. After that, those who want will be able to make the deed transaction, sale and transfer from the notary public, especially the house purchase and sale. In addition to the amount calculated for the title deed fee, these persons will also pay an additional notary fee of the determined amount.

The purpose of authorizing notaries to issue real estate sales contracts is to reduce the intensity of bureaucratic procedures.

How will the deed process work at the notary public?

The title deed registration sample and other documents will be shared with the notaries through the land registry information system by the General Directorate of Land Registry and Cadastre (TKGM). Technical preparations continue for the notary publics to receive data from the Land Registry and Cadastre Information System (TAKBIS). In cases where the relevant documents of the immovable are missing, these documents will be requested through the system and the deficiencies will be transferred to the system by the land registry directorate.

⦁ After the notary public determines the right owner and confirms that there is no obstacle to the sale, a real estate sales contract will be made.

⦁ When the sales contract is signed by the parties, the notary public will get the journal number from the land registry information system and save the contract in the system.

⦁ After the contract is registered in the system, the real estate will be registered to the land registry by the land registry office.

⦁ Along with the sales contract, other documents will be transferred to the system by the notary public and will be physically archived.
