Some monetary thresholds in the Law on the Regulation of Electronic Commerce have been increased

It has been decided to increase some monetary thresholds in the Law on the Regulation of Electronic Commerce by half.

The Presidential Decision on the subject was published in the Official Gazette.

With the decision, the monetary thresholds specified in the additional articles of the Law on the Regulation of Electronic Commerce titled unfair commercial practices in electronic commerce, the obligations of the electronic commerce tool service provider and the liabilities of the electronic commerce service provider were increased by half.

These articles regulate the liabilities of these sectors according to their transaction volumes.

In the provisional article of the law, there was a provision that the thresholds specified in the said articles could be increased by half by the President in February 2023.

In the announcement shared on the Twitter account of the Ministry of Commerce, the following statements were included:

“In the law, the net transaction volume concept has been taken as a basis while determining the obligations of electronic commerce marketplaces and other enterprises engaged in electronic commerce activities such as licenses, advertisements, discounts, independent audits, data transport and use. This concept, in essence, refers to the total monetary value of transactions realized through electronic commerce environments of enterprises. As the monetary thresholds in the law need to be updated, the thresholds specified in the Law as ₺10, ₺30 and ₺60 billion for 2022 have been increased by half to ₺15, ₺45 and ₺90 billion, respectively.”
