Turkiye: Changes were made in the regulation of duty-free shops

The regulation of duty-free shops was amended and the concept of “Turkish Straits” was included in the regulation.

The Regulation Amending the Regulation on Duty-Free Shops entered into force after being published in the Official Gazette.

With the regulation, the phrase “from the Bosphorus and the Dardanelles” in the first paragraph of Article 1 of the Duty-Free Shops Regulation was changed to “from the Turkish Straits”, and the phrase “by the Ministry of Customs and Trade” to “By the Ministry of Commerce”.

With the said regulation change, the concept of “Turkish Straits” in the Turkish Straits Maritime Traffic Regulation was included in the regulation, and the amount of paid-in capital required for the opening of a duty-free shop/warehouse, the average amount of Corporate Tax and the amount of guarantees were updated within the framework of economic developments.

Due to the fact that duty-free shops are also private warehouses, the 5-year operating period was abolished in line with the amendment made in the Customs Regulation, and the documents required for the opening of the duty-free shop were updated. The matters that should be included in the eyewitness report prepared by the customs administration were clearly stated.

With the regulation, it was possible to shop with anonymous credit cards. In order to be able to sell to ships with Turkish flag from the sales stores to ships, it was required to confirm from the customs administration that these ships are considered as overseas voyages.

It has been added to the regulation that the detection of the duty-free shop or warehouse being used outside of the specified fields of activity is a situation that causes the temporary suspension of the activities of the shops and warehouses.
